PINK COAT, MD'S LEGAL TERMS FOR PARTICIPATION

I understand that all meetings facilitated by Pink Coat, MD are intended to be confidential in order to allow for the open sharing of experiences. I agree to keep confidential and not share with any person any of the personal experiences shared by the participants in such meetings.

I understand that I alone am responsible for any decisions I make based on the advice available through Pink Coat, MD and any people I meet through Pink Coat, MD. I agree that Pink Coat, MD and the persons associated with it are not liable for any of my career decisions, adverse career or life events, or anything else that I decide or that happens to me in my career or personal life. 

Any legal or equitable claim relating to Pink Coat, MD's services shall be resolved under California law as it applies to parties and transactions located in that state. Any claim against Pink Coat, MD and the person associated with it may only be brought in the state and federal courts located in San Francisco, California.

VIDEO CONSENT AND RELEASE OF PINK COAT, MD

Effective as of the date of the participant’s consent to this release, approval for past use and permission for present and future use is being granted to Pink Coat, MD to use a visual- and/or voice-recording of the participant agreeing to the terms of this release (the "Participating Doctor"). Permission is being given by the Participating Doctor, as more fully explained in this Consent and Release. The Participating Doctor is an adult and fully authorized to agree to the terms of this Consent and Release.

The Participating Doctor hereby gives Pink Coat, MD her consent to be photographed, audio- and/or video-recorded as a result of her participation in Pink Coat, MD’s online and in-person programs and events.

For the valuable consideration of being allowed to participate in Pink Coat, MD’s course offerings, receipt of which is hereby acknowledged, the Participating Doctor hereby grants to Pink Coat, MD, its partners, agents, employees, licensees, and successors in interest (collectively, the "Released Party") all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish the recorded image and/or voice of Participating Doctor (the "Image and/or Voice") that has been (or is being) obtained pursuant to this Consent and Release.

The Image and/or Voice may be copyrighted, used and/or published individually or in conjunction with other photography, video works, and recordings, and in any medium (including without limitation, print publications, public broadcast, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication.

The Participating Doctor represents and warrants that (i) no other party has been granted an exclusive license with respect to the Image and/or Voice, and (ii) no other party's authorization or consent is required with respect to the permission granted to the Released Party under this Consent and Release.

The Participating Doctor waives any right that the Participating Doctor may have to inspect or approve the Released Party's use of the Image and/or Voice, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Image and/or Voice. The Participating Doctor releases the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Image and/or Voice (collectively, "Claims"). This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Image and/or Voice.

THE PARTICIPATING DOCTOR WARRANTS THAT THE PARTICIPATING DOCTOR HAS READ THIS CONSENT AND RELEASE PRIOR TO AGREEING TO THE TERMS OF THIS DOCUMENT, THAT THE PARTICIPATING DOCTOR UNDERSTANDS IT, AND THAT THE PARTICIPATING DOCTOR FREELY ENTERS INTO THIS CONSENT AND RELEASE.
